IT AND GENERAL SRLS operates with the utmost transparency, offering competitive pricing and a professional and reliable purchasing experience.
We are committed to delivering value and qualified support, placing the Customer’s needs at the center of our activities.

This commitment includes, among other things, the possibility for the Customer to freely select the preferred carrier during the checkout process, retaining full control over shipment.


2. Scope and Applicability

These General Terms and Conditions of Sale (“Terms”) govern the sale of:

  • hardware products

  • software licenses

  • consulting and technical support services

made through the website https://itg-shop.eu (the “Website”).

By placing an order through the Website, the Customer fully accepts these Terms.


3. Order Classification

For legal and tax purposes, orders are classified as follows:

3.1 Business-to-Business (B2B)

An order is classified as B2B when the Customer:

  • provides a valid VAT number, or

  • requests the issuance of a commercial invoice

In such cases, the provisions of the Italian Civil Code apply.

3.2 Business-to-Consumer (B2C)

An order is classified as B2C when the Customer purchases as a private individual without a VAT number.
The protections provided by the Italian Consumer Code (Legislative Decree No. 206/2005) and applicable European Union regulations apply.


4. Contract conclusion and product suitability

The order submitted by the Customer constitutes a contractual offer. The contract is concluded only upon order confirmation by IT AND GENERAL SRLS.

The Customer is responsible for verifying the technical suitability of the purchased products, including compatibility, requirements, and configurations necessary for proper operation.

 


5. Prices and payments

All prices are expressed in Euros (€) and may be inclusive or exclusive of VAT depending on Customer classification.

Payments are processed through secure systems compliant with PSD2 regulations.

Any additional costs related to customs duties, local taxes, or extra-EU shipments are borne by the Customer.

 


6. Shipping and delivery

Orders for in-stock products received by 11:30 a.m. are generally processed on the same working day.

Shipments are handled by carriers selected by the Seller, which may vary depending on availability and destination.

Estimated delivery times:

  • Italy: 24–48 working hours
  • European Union: variable depending on destination

Free shipping is not included unless explicitly stated.

The Customer must inspect the package upon delivery and, in case of anomalies, accept with reservation.


7. Transfer of risk

For B2B Customers, risk transfers upon delivery of goods to the carrier.

For B2C Customers, risk transfers upon physical delivery to the Customer.


8. Warranty and conformity

8.1 Warranty Period

B2B Customers:
12-month commercial warranty pursuant to the Italian Civil Code, unless otherwise agreed in writing.

B2C Customers:
24-month legal warranty of conformity pursuant to Articles 128–135 of the Italian Consumer Code.

8.2 Netgate RMA Procedure

For Netgate products, prior technical authorization (RMA) must be obtained through the manufacturer’s TAC Support:

Without approved RMA authorization, returns, replacements, or repairs cannot be processed.

8.3 Warranty Exclusions

The warranty does not cover defects, malfunctions, or damages resulting from:

  • power surges or electrical events
  • hardware tampering
  • incorrect installation or configuration
  • improper or non-compliant use
  • operation in unsuitable environmental conditions

8.4 General conditions

The warranty does not cover damage resulting from misuse, negligence, or unauthorized modifications to the products.


9. Right of withdrawal

B2C Customers may withdraw within 14 days of receiving the product without stating any reason.

In case of withdrawal:

  • product refunds are issued
  • standard shipping costs are refunded
  • express or additional shipping costs are excluded

Return shipping costs are borne by the Customer.

B2B Customers have no right of withdrawal for reconsideration.

The right of withdrawal does not apply to:

  • software licenses
  • activation keys
  • digital services already provided

10. Returns and refunds

Defects or non-conformity must be reported within 2 months of discovery.

If confirmed:

  • return shipping costs are covered by the Seller
  • the Customer is entitled to repair, replacement, or refund

Returned products must be complete, unused (where applicable), and in original packaging.

Refunds are issued within 14 days of receipt and inspection, using the original payment method.

Non-refundable items include:

  • activated licenses
  • used or activated software
  • already delivered services
  • products missing accessories or original packaging

11. Technical support and services

Technical support is provided as a separate service and may be subject to specific terms and SLAs.

It does not include activities not explicitly agreed upon and does not replace the Customer’s responsibility for system management.

The Customer remains fully responsible for configuration, security, and operation of their infrastructure.


12. Product availability

Product availability shown on the Website is indicative only.

If a product is unavailable:

  • it may be ordered from the supplier
  • delivery times may vary
  • the Customer will be informed of updated timelines

 


13. Invoicing

For B2B Customers, invoicing is automatic.

For B2C Customers, invoices are issued upon request where required by law.

 


14. Data protection and hosting

Personal data is processed in compliance with EU Regulation 2016/679 (GDPR).

The Website infrastructure is managed by IT AND GENERAL LIMITED, with servers located in the United Kingdom, in accordance with the EU Adequacy Decision of 28/06/202.

15. Governing law and jurisdiction

These Terms are governed by Italian law.

For B2B Customers, the exclusive jurisdiction is the Court of Rome.
For B2C Customers, jurisdiction lies with the court of the consumer’s place of residence or domicile.

16. Force majeure

IT AND GENERAL SRLS is not liable for delays or failures caused by events beyond its reasonable control, including but not limited to:

  • natural disasters
  • strikes
  • logistics disruptions
  • service interruptions
  • supplier unavailability

17. Amendments to the Terms

IT AND GENERAL SRLS reserves the right to modify these Terms at any time.

Changes apply only to orders placed after publication on the Website.


Version updated on: 08/04/2026

These Terms replace all previous versions published on the Website and apply to all orders placed from the above date onward. Orders placed prior to this date remain governed by the Terms in force at the time of order confirmation.
